Abstract

Traditionally, the concept of punishment has been associated with imprisonment as a means of deterrence, which was reduced to a tool for punishment and deterrence, before undergoing a fundamental shift in modern penal thought. The function of the penal institution has shifted from a tool of punishment to a space for reform, based on re-education and rehabilitation, adopting a humane approach that views the prisoner as an individual capable of reform and in need of care and treatment. This functional shift contributes to promoting the social reintegration of prisoners and reducing recidivism rates, through the implementation of educational, rehabilitative and therapeutic programmes within penal institutions, thereby serving the objectives of social prevention and the achievement of social stability.
