Abstract

Freedom of speech and expression is one of the fundamental pillars of democracy and is guaranteed under Article 19(1)(a) of the Constitution of India. In the digital age, social media platforms have significantly expanded opportunities for communication, public participation, political discussion, and exchange of ideas. Platforms such as Facebook, X (formerly Twitter), Instagram, YouTube, and WhatsApp allow individuals to express opinions instantly and reach global audiences. However, the rapid growth of social media has also increased the spread of hate speech, misinformation, online harassment, communal incitement, and offensive content, creating serious legal and social challenges. the relationship between freedom of speech and hate speech laws in the context of social media from a legal and constitutional perspective. It analyzes the constitutional protection of free speech, reasonable restrictions under Article 19(2), and the legal framework governing hate speech and online communication in India. The role of information technology laws, criminal laws, and judicial interpretation in regulating harmful online content while protecting democratic freedoms.
